Cuyahoga County Municipal Courts

Civil dog bite claims up to $15,000 are heard in the municipal court covering the city where the bite occurred. Claims exceeding $15,000 must be filed in the Court of Common Pleas. Small claims handles up to $6,000.

Evidence Preservation Guide

Evidence degrades quickly — injuries heal, witnesses forget, records get purged. Acting fast is the single most important thing a bite victim can do.

Immediate Steps — First 24–48 Hours

  • Seek medical attention immediately — even if the wound appears minor. Medical records near the date of the bite are foundational evidence.
  • Photograph every wound — before treatment if possible, and after bandaging is removed. Continue during healing, especially wounds that may scar.
  • Photograph the scene — including fencing, leash hardware, gates, or enclosures that were open, broken, or absent.
  • Identify the dog and owner — name, address, phone number. Ask if the dog has bitten before. Request vaccination records.
  • Get witness information — names, phone numbers, and addresses of anyone who saw the attack or its aftermath.
  • Call 911 or the police non-emergency line — an official police incident report creates a contemporaneous record.
  • Report to Cuyahoga County Board of Health — (216) 201-2001.

Records to Request — Within the First Few Weeks

  • Police incident report — and any prior reports involving the same dog or owner address.
  • Animal Warden / Animal Control Officer records — bite investigation reports, quarantine orders, prior complaint history, and dangerous dog classification records.
  • Cuyahoga County Board of Health records — all bite reporting and quarantine records for the incident and the animal.
  • Prior municipal court records — ordinance violation citations against the owner establish documented history of failure to control the animal.
  • All medical records and itemized bills — every visit, surgery, therapy session, and prescription from every provider.

Ongoing Documentation

  • Keep a daily injury journal — pain levels, activity limitations, sleep disruption, emotional distress. Date every entry.
  • Photograph scars throughout healing — final appearance may not be apparent for 12–18 months.
  • Preserve all clothing and personal items — anything torn or bloodied. Do not wash or discard.
  • Track all out-of-pocket expenses — transportation, medications, equipment, lost wages. Keep receipts.

Insurance & Claims Information

Homeowner's & Renter's Insurance

The most common recovery source in dog bite cases. Standard policies typically include personal liability at $100,000–$300,000. Some exclude certain breeds or dogs with prior bite history. An attorney can identify the applicable policy and communicate with the carrier on your behalf.

Landlord and Property Owner Liability

When a bite occurs on rental property and the landlord qualifies as a "harborer" under R.C. § 955.28, the landlord's premises liability policy may be an additional recovery source — most relevant in majority-renter cities like Warrensville Heights and University Heights.

Medical Resources for Dog Bite Victims

Dog bites carry significant infection risk even when wounds appear minor. Puncture wounds are especially dangerous — they close at the surface while bacteria proliferate below. Any bite that breaks the skin requires prompt evaluation.

Rabies Post-Exposure Protocol

If the biting dog's vaccination status cannot be confirmed, contact the Cuyahoga County Board of Health at (216) 201-2001 to assess whether rabies post-exposure prophylaxis (PEP) is recommended. PEP is highly effective when administered promptly. Its cost is recoverable as damages in a dog bite claim.

Under R.C. § 149.43, all records created or received by Ohio government agencies are public unless specifically exempted. You do not need to explain why you are requesting records.

What to Request and From Whom

  • From the responding police department: The incident report, prior reports involving the same dog or owner address, and any animal-at-large citations issued.
  • From Animal Control / Animal Warden: The bite investigation file, quarantine order, prior bite reports for the same animal, and prior complaint records.
  • From the Cuyahoga County Board of Health: All bite reporting and quarantine records for the incident and the animal.
  • From the Cuyahoga County Animal Shelter: Intake records, hold records, and behavioral history for any impounded animal.
  • From the municipal court: All prior citations and case records involving the owner for animal ordinance violations.
